Terms & Conditions

By applying to become a member of Black Lives in Music you agree to comply with the membership commitment and the terms and conditions set out below.

General

1. Please read these Terms and Conditions of Membership (“Terms”) carefully, as payment of the membership fee constitutes your acceptance of these Terms.

2. Black Lives in Music (“BLiM”) reserves the right to update the Terms at any time by displaying amended Terms on the BLiM website. 

3. BLiM’s Membership Commitment and our website terms and privacy policy form part of the Terms.

4. Your membership of BLiM and your entitlement to membership benefits will run from the date we receive your membership fee. For this reason, you have no right to cancel under Regulation 10 of the Consumer Protection (Distance Selling) Regulations 2000, as provided by Regulation 13(a) of those Regulations.

5. Your membership runs for a period of one calendar year from when we receive your membership fee.  We will send you an invoice for the renewal of your membership at least  30 days before the date on which your membership is due to run out and, if you pay the renewal membership fee by that date, your membership will continue for a further calendar year from that date. If you do not pay it by that date, your membership will lapse. 

6. If you pay your membership fee by standing order or Direct Debit, and you do not wish to renew your membership, you must notify us at the earliest opportunity and in any event no later than 28 days before the date on which your membership is due to run out.

7. Prices for membership are displayed on our website and are inclusive of VAT (if applicable).  The website also sets out the payment methods that we accept.

8. Membership of BLiM is not transferable. 

Cancellation

9. We reserve the right to cancel your membership of BLiM if, in our reasonable opinion, you have breached the Terms (including the terms of use of our website) or you have not complied with the Membership Commitment. If we do cancel your membership, we will notify you of our decision but we will have no further liability to you.

10. If at any time you wish to stop being a member of BLiM, please contact us as soon as possible. Please note, however, that no refund of your membership fee will be provided if you cancel.     

BLiM materials

11. Copyright in publications and other materials that we provide to members belongs to BLiM unless otherwise indicated, and we do not grant you any right to copy, transmit, distribute, sell or commercially exploit such materials without our prior written consent.

12. Any information that we provide to you is on an “as is” basis and, while we make reasonable efforts to ensure the accuracy of such information, we cannot guarantee its accuracy or completeness, nor that it does not infringe the right of any third parties. materials.

Our liability to you

13. Subject to paragraph 19 below, BLiM shall have no liability to any member or to any third party for any loss of profit or any special, incidental or consequential damages (however arising, including negligence) arising out of, or in connection with our membership services, and liability of any other kind is limited to the annual membership fee paid by the member concerned.

14. Nothing in these Terms excludes liability for death or personal injury caused by negligence on our part, nor for fraud or fraudulent misrepresentation.

Contacting you and how we use personal data

15. When you apply for membership, we will ask you to provide contact details (including your postal and email addresses) so that we can contact you about your membership and deliver the benefits to which you are entitled as a member.

16. We will contact our members by post and/or by email, subject to your rights under paragraphs 17 to 19 below.

17. You may opt-out of member communications at any time, but please note that it is through these communications that we deliver our services to members and, if you do opt-out, we may be unable to deliver your membership benefits.

18. You are responsible for informing us of any changes to your contact details.  If you would like to change how we communicate with you, please let us know by writing to us at the address given at the end of this document.  

19. Please note that you may at any time unsubscribe from emails from BLiM by clicking on the unsubscribe link at the bottom of our email.

20. If you have recently stopped being a member of BLiM, we may contact you again for a reasonable period to ask you whether you would like to rejoin BLiM.

21. We take your privacy seriously. You can find out more about your rights, how we use your personal data and how we keep your details safe and secure by looking at our Privacy Policy [URL].

Governing law and jurisdiction

23. These terms and conditions and your use of the Website will be governed by and construed in accordance with English law and you agree that any disputes arising in connection with the same will be subject to the exclusive jurisdiction of the English courts.
